Chinese lawyer goes on trial in dissent crackdown (AP)

BEIJING ? A former lawyer and veteran activist left disabled by past police mistreatment went on trial Thursday, the third dissident in a week to be prosecuted as China presses a sweeping crackdown to deter popular uprisings like the ones that shook the Arab world.

Looking thin and frail, Ni Yulan lay on a bed and used an oxygen machine to help her breathe during the hearing, her daughter, Dong Xuan, said afterward. Dong said she told the court about her mother's run-ins with police since 2002 and how police beatings left her crippled.

"Seeing my mother lying on that bed, it made my heart ache," Dong said.

Ni is charged with fraud, accused of falsifying facts to steal property. She is also charged, along with her husband, with causing a disturbance at a hotel where they had been detained by police.

Ni and her supporters deny the charges and say she is being punished for her years of activism, especially her advocacy for people forced from their homes to make way for the fast-paced real estate development that remade Beijing for the 2008 Olympics. Her outspoken defense earned her the enmity of officials and developers. Her family's house in an old neighborhood in the capital's center was also razed, and the couple became homeless.

The couple's trial comes near the end of a year that has seen Chinese authorities use disappearances, house arrest, lengthy prison terms and other means to prevent activists from drawing inspiration from the Arab Spring protests that unseated autocrats in Egypt, Tunisia and Libya.

In the past week, two longtime democracy and rights activists, Chen Wei and Chen Xi, were separately sentenced by courts in southern and central China to nine and 10 years in prison for posting essays on the Internet that the government deemed subversive.

Referring to the two cases, an editorial published in China's state-run Global Times newspaper on Thursday expressed support for the convictions.

"To firmly convict and punish a handful of people who instigate subversion of state power is a must. It is a safeguard for state security and a safeguard for a normal environment for public opinion," the newspaper said.

Like those two campaigners, the 51-year-old Ni has been previously jailed, twice in her case. In a June 2010 interview with The Associated Press, Ni described abuse she suffered at the hands of police, saying that guards have beaten her, insulted her and urinated on her face. While in detention in 2002, police pinned her down and kicked her knees until she was unable to walk, she said.

While serving the second prison term of two years, Ni said she was deprived of her crutches and had to crawl up and down five stories and across the prison yard every day for months.

Ni said the authorities were trying to silence her because in trying to defend those who had been wrongly evicted from their homes, she had found evidence of wrongdoing by Beijing officials in lucrative land deals.

"When they were making me crawl in prison, they were basically trying to kill me so that they can silence me," Ni said in the 2010 interview. "Isn't it just because I'm trying to tell the truth?"

In a sign of the government's sensitivity over the case, Thursday's trial took place under heavy security. Dozens of uniformed police sealed off and patrolled roads around the courthouse, rounding up journalists and about a dozen diplomats from the United States and Europe and taking them to a small office across from the building.

Ni told the court she was not guilty, said her lawyer Cheng Hai, outside the courthouse. Cheng spoke only briefly as he was being pushed away from reporters by plainclothes men who did not identify themselves.

Dong said she was happy to see her parents for the first time in the nearly nine months but she was not optimistic about the outcome of the trial, citing the couple's lengthy detention and the heavy security presence at the courthouse.

"This is definitely not a normal trial procedure, so I feel the risk of conviction is high," she said.

Marketplace for health insurance exchange draws closer | PennLive ...

Pennsylvania has moved more slowly than some states but is making progress toward a health insurance exchange ? even with a governor who opposes the federal health care law.

Pennsylvania and most other states applied for and received a $1 million grant toward the early costs of creating an exchange, which is required by the law championed by President Barack Obama and approved by Congress in 2010.

The purpose of the exchange is to provide an online store where individuals and small businesses can compare and buy health insurance. Other goals include making health insurance easier to understand and creating more competition among insurers.

All states must create an exchange or the federal government will do it for them.

Pennsylvania used the initial grant to hire a consultant to carry out tasks such as surveying businesses and the public on what they want from an exchange.

Now people in the state Department of Insurance are finishing up the application for a second grant to fund more work toward creating the exchange.

About 30 states have applied for such grants and received amounts ranging from $1.6 million in Tennessee to nearly $40 million in California.

?Pennsylvania has taken steps towards the establishment of an exchange, which I think is positive. ... There are other states who have moved more aggressively, including states whose governors are part of the lawsuit,? said Sharon Ward, director of the Pennsylvania Budget and Policy Center, a nongovernment organization that supports the federal health care law.

Ward was referring to the lawsuit challenging the health care law largely on the argument that it is unconstitutional to require people to buy health insurance.

Gov. Tom Corbett, who joined the lawsuit when he was attorney general, is among leaders from 26 states pursuing the lawsuit. The U.S. Supreme Court plans to hear arguments in March.

State Rep. Anthony DeLuca, D-Allegheny County, the minority chairman of the House Insurance Committee, believes the Corbett administration has ?been dragging their feet a bit? with the hope the Supreme Court will strike down the law.

Still, he said Pennsylvania is making adequate progress, and he isn?t worried the state will miss the Jan. 1, 2014, deadline to have the exchange up and running or lose out on grant money.

Rosanne Placey, a spokeswoman for the state Insurance Department, said Corbett?s view on the law isn?t affecting Pennsylvania?s pace.

?While the governor believes that the law requiring the purchase of health insurance is unconstitutional, we must be prepared if the Supreme Court does not strike down the law. Making sure Pennsylvania is prepared in case that happens is the prudent thing to do,? Placey said.

Although the federal law contains far-ranging mandates, it also gives states flexibility in tailoring exchanges to meet states? particular needs.

That means Pennsylvania must make many choices, such as how generous the benefits of health plans offered through the exchange must be, whether it will limit participation to businesses with no more than 50 employees, and who will run the exchange.

Advocates, including Ward, want the exchanges to be set up in a way that shields against excessive influence by the health insurance industry and minimizes the role of politics.

Pennsylvania has decided it will have a state-run exchange, meaning it likely will be run by an existing state agency such as the Department of Insurance or the Department of Public Welfare.

Ward was hoping Pennsylvania would opt to run it with a nonprofit entity, which she believes would provide greater insulation against state politics.

Pennsylvania has settled on some specifics of the exchange, but those won?t be publicly known until the state files its next grant application, which is expected to occur in the next few weeks, said Melissa Fox, a spokeswoman for the Insurance Department.

Ward believes the exchanges will withstand the legal challenges.

?It will certainly make it easier for people to shop for insurance. ... This is an idea whose time has come,? she said.

Most of the opposition to the health care law has come from Republicans, with all the leading contenders for the Republican nomination for president promising to repeal the law, which has many components beyond health insurance exchanges.

Yet in assorted Republican-led states, resistance to the exchanges has thawed, largely because of acknowledgment that the current health insurance market is dysfunctional and exchanges might help, according to Kaiser Health News.

State Sen. Pat Vance, R-Cumberland County, said the law contains ?some good things and some bad things.?

The exchanges are among the good things.

?I think people need to be able to compare health care costs. Right now it is difficult if not impossible to compare health insurance plans. I think the consumer is the winner in that,? she said.

The bad things, in Vance?s view, include too much power placed in the hands of the U.S. Department of Health and Human Services.

The federal law calls for subsidies to make coverage affordable for people earning between 133 percent and 400 percent of the federal poverty level and some small businesses. One of the purposes of the exchange will be to match people and businesses with subsidies.

People who earn less than 133 percent of the poverty level also will receive coverage through the exchange, but it will come from an existing government program, Medicaid.

Pennsylvania?s effort has included three public forums, held over the summer, and comments accepted online that drew input from 814 residents and 204 business owners and health insurance decision makers, according to the Insurance Department.

The surveys suggest a substantial lack of awareness surrounding the exchanges.

Four out of five businesses were ?unaware of the health insurance exchanges and confused by the name.?

Among consumers, only one in 10 was aware of the exchanges.

Among the other findings: 40 percent of Pennsylvania small businesses don?t offer coverage; less than half feel their plan offers excellent value; 56 percent of consumers have insurance through work; and, of those who are uninsured, most lost their job or don?t have access to coverage through work.

About 2 million uninsured Pennsylvania residents are expected to seek coverage through the exchange.

Nolan Ryan Bit by Coyote, Helps Inspire New Baseball Cards

In 1985, Nolan Ryan, then with the Houston Astros, was bitten by a coyote while reaching into a dog pen. In 2006, Amelie Mancini left Paris to move to New York and fall in love with baseball. These two seemingly insignificant events collide with a new set of handmade baseball cards that mix pain and art.

Bizarre Injuries is the first set of cards from Mancini's Left Field Cards. Just like the name suggests, these aren't your average cards. Rather than taking the traditional approach of photographs and mass copies, Mancini's cards are by hand in the basement of a local church using linocuts.

"It's a kind of printmaking," explains Mancini. "A block of linoleum is carved by hand and then inked and pressed on the paper, leaving a print that has some relief to it."

Bizarre Injuries is sold as two separate five-card packs. One pack has cards of Ryan, John Smoltz, Bret Barberie, Terry Mulholland and?Glenallen Hill, who hurt himself in the midst of a spider nightmare. The second pack features Wade Boggs, Clint Barmes, Adam Eaton, Kevin Mitchell and Joel Zumaya. Each pack of five cards is $15.

Just like the subject matter, the cards aren't like traditional baseball cards. They measure 4 x 6, like a postcard.

"I got the idea after seeing one of these super-sized cards that came in single packs in the '80s," says Mancini.

Mancini, who holds a Master's Degree in Design and Fine Arts from Sorbonne University in Paris, moved to New York five years ago and soon discovered baseball.

"I didn't know anything about baseball until a couple of friends took me to Shea Stadium one afternoon in September, 2007. The Mets lost, of course," remembers Mancini. "Over the next couple of years I started watching games regularly, talking to people, reading books, and the more I found out about the game, the more fascinated I became. By then I'd finally realized what a bad decision it had been to become a Met fan [and] how miserable I would be. But at the same time I just loved reading about the '69 and '86 Mets. I've been a most loyal and passionate fan."

Mancini, who has a collection of Mets and other random cards, already has another set of cards in the works: Edible All-Stars, which is scheduled to be released in late January or early February. Following that, Mancini is unsure exactly where she'll go, but is planning to do one on epic baseball mustaches.

As for Bizarre Injuries, Mancini explains her inspiration, "I wanted a fun, silly, weird theme and this came to me after reading fun facts about baseball players on the Internet."

She said she doesn't have plans for another injuries set, but is open to it as long as players continue to hurt themselves in strange ways.

Brazil to involve Chevron in oil spill lawsuit

The Chevron oil company is facing an $10 billion lawsuit over a spill of about 3,000 barrels of crude oil.

While Chevron has claimed it acted quickly to contain the massive oil spill which occurred off the coast of Rio de Janeiro, Brazil has said the company is responsible for breaching its environmental licence by responding slowly and lacking the correct equipment to tackle the disaster.

Chevron has already been fined $28 million by the Brazilian environmental watchdog for causing the spill.

All drilling operations of Chevron and its contractors have been suspended in the country.

The spill happened at a well in the Frade oil project, 370 kilometres off the Brazilian coast where billions of barrels of oil are amassed in deep water.

Victim's sis surprised producer OK with extradition

Bruce Beresford-Redman, the former "Survivor" producer accused of murdering his wife Monica, will not fight extradition from the United States to be put on trial in Mexico for that April 2010 crime, TODAY's George Lewis reported Tuesday. The decision comes after a federal judge in Los Angeles ruled there was enough compelling evidence to warrant the extradition.

This came as unexpected good news to Beresford-Redman's sister, Carla Burgos and the family attorney Alison Triessel, who spoke with TODAY's Savannah Guthrie.

"We were surprised because given the vigor with which he has fought this, tooth and nail every step of the way, we were really surprised that now he has decided to waive extradition and go back to Mexico," said Triessl. "I had prepared the Burgos family for another fairly long battle."

The Beresford-Redman family had been vacationing at a Cancun, Mexico, resort when Monica went missing; three days later she turned up in a hotel sewer. After being asked by officials to remain in the country, Beresford-Redman returned home to the U.S. and has been held in a federal detention center since Nov. 2010.

The entire orderal, said Burgos, has been "really painful ... my parents, my father, he was always a really happy man, easygoing and stuff, and he's been so sad and angry about this situation."

Burgos says there's been no contact between the her family and Bruce Beresford-Redman, and she objects to having the 7- and 4-year-old children living with his parents. "That's not what we want, we don't think that's the best for them," said Burgos.

Juanita Beresford-Redman proclaimed her belief in her son's innocence last week on TODAY: "I know he is innocent, he is a good man, and of course I trust him completely."

By not fighting the extradition, Triessl said that Beresford-Redman could be headed back to Mexico within 60 days. He is expected to face charges of aggravated homicide.

And Burgos says she has faith in the Mexican legal system to handle the case once Beresford-Redman arrives back in that country. "They've been really fair during all this process, and we really hope they keep doing it," she said. "Because we need justice for (Monica). She didn't deserve to go like that."

KANSAS CITY, Mo. (AP) ? Carson Palmer knew that Darrius Heyward-Bey, perhaps the Oakland Raiders' fastest wide receiver, could beat the Kansas City Chiefs defense if he went deep down the field.

The Raiders just had to wait for the right moment.

It came on the first play of overtime.

Heyward-Bey beat safety Kendrick Lewis down the left side and Palmer hit him for a 53-yard gain, setting up Sebastian Janikowski's 36-yard field goal 2:13 into overtime Saturday for a 16-13 win that kept the Raiders' playoff hopes alive and eliminated Kansas City from contention.

"It was the right time to call it," Palmer said. "I wanted it earlier, but we saved it for the right time. The protection was flawless and the route was great."

It was just about the only thing that was flawless.

The Raiders committed 15 penalties for 92 yards, one of them ? a delay of game ? wiping out an audacious fake field goal that would have gone for a 36-yard touchdown pass. Palmer also threw a pair of interceptions and the Raiders converted only 3 of 11 third-down opportunities.

"An ugly win is better than a pretty loss," Palmer said.

Especially given the stakes.

Oakland (8-7) can win the AFC West by beating San Diego next week and getting some help from ? of all teams ? the Chiefs, who travel to Denver for a game that's become meaningless to them.

"The man told me, 'Hue, we'll win it in the end.' I believe that," said Raiders coach Hue Jackson, reflecting on a conversation he had with Al Davis before the Raiders owner died in October. "I don't know how it's going to happen. I don't care how it's going to happen."

Oakland led 13-6 late in the fourth quarter when Kyle Orton connected with Dexter McCluster for a 49-yard gain, setting up a short TD toss to Dwayne Bowe with 1:02 remaining in regulation.

The Raiders went three-and-out in short order, giving Kansas City the ball back with only enough time to get into field-goal range. Orton hit Bowe for 25 yards and Terrance Copper for 11 more to set up Ryan Succop, whose 49-yard try was blocked as time ran out.

It was the second field goal that Succop had blocked.

"We had an opportunity to win the game. Those guys came up big," Chiefs linebacker Tamba Hali said. "I mean, blocking two field goals ? what's the odds of blocking two field goals in a big game like this? More credit to those guys."

The Raiders, who blew a 13-point lead in the final five minutes to Detroit last week, have won five straight games at Kansas City. Perhaps none was important as this one, with all four teams in the division beginning the day with a chance of squeaking into the playoffs.

The Chiefs (6-9) struggled to take advantage of drives one week after piling up a season-best 438 yards of offense in a 19-14 victory over previously unbeaten Green Bay. That was their first game with Orton under center and interim coach Romeo Crennel calling the shots from the sideline.

Orton threw a pair of interceptions against Oakland, one of them in the end zone in the second quarter and the other as the Chiefs were driving in the fourth quarter.

"I commend everybody for fighting hard and giving us a chance at the end," Orton said.

The first half amounted to a cacophony of errors that ended in a 3-3 tie.

The Raiders, the most penalized team in the NFL and on pace to set a single-season record, were flagged 10 times for 57 yards, while the Chiefs were flagged eight times for 53 yards.

It wasn't just the quantity of penalties, either. It was the quality.

Javier Arenas had an interception of Palmer wiped out by defensive holding in the first quarter, a turnover that would have given Kansas City prime field position.

The Raiders returned the favor on their next possession. Facing fourth-and-2 at the Chiefs 36, they pulled off fake field goal in which punter Shane Lechler, the holder on the play, threw a shovel pass to tight end Brandon Myers, and he ran untouched around end for the touchdown.

It was called back by a delay of game penalty, and Janikowski's 58-yard try hit the crossbar.

Bowe dropped an easy touchdown catch on the Chiefs' ensuing possession, and Orton was picked off by Matt Giordano in the end zone. Palmer gave it right back when Arenas intercepted him.

The Chiefs promptly wasted another scoring opportunity with a staggering string of penalties: intentional grounding, a delay of game and a false start, all in succession. Succop ultimately had his long field attempt blocked by Richard Seymour, his first miss since Sept. 25 at Buffalo.

It wound up being all the more important by the end of regulation.

"Our guys fought and they hung in there, went into overtime, and it took some guts to do that," Crennel said. "We had a couple of field goals blocked, we got a couple balls thrown over our head, we turned the ball over a couple times. In the NFL, it's hard to win when you do those kinds of things."

Notes: The Raiders have been penalized 155 times for 1,293 yards this season. Kansas City has the NFL record with 158 for 1,304, set in 1998. ... Oakland played without RB Darren McFadden (mid-foot sprain) for the eighth straight game. Michael Bush ran 23 times for 70 yards in his place. ... Chiefs S Jon McGraw (ankle) did not play. ... CIA's watchdog: No problem with NYPD partnership

(AP) ? The CIA said Friday its internal watchdog found nothing wrong with the spy agency's close partnership with the New York Police Department.

The agency's inspector general concluded that no laws were broken and there was "no evidence that any part of the agency's support to the NYPD constituted 'domestic spying'," CIA spokesperson Preston Golson said.

The inspector general decided to do a preliminary investigation after a series of stories by The Associated Press revealed how after the 9/11 attacks the CIA helped the NYPD build domestic intelligence programs that were used to spy on Muslims. A CIA officer also directed intelligence collection and reviewed reports, according to former NYPD officials involved.

The revelations troubled some members of Congress and even prompted the U.S. director of national intelligence, James Clapper, to remark that it did not look good for the CIA to be involved in any city police department. Thirty-four lawmakers have asked for the Justice Department to investigate but so far that request has gone nowhere.

New York Police Commissioner Raymond Kelly has maintained the NYPD's relationship with the CIA was proper. Under an executive order the CIA is allowed to assist local law enforcement.

"Operating under this legal basis, the CIA has advised the police department on key aspects of intelligence gathering and analysis that have greatly benefited our counterterrorism mission and protected lives in New York City," Kelly said earlier this year.

David Buckley, the CIA's inspector general, completed his review in late October. It's not clear if his report opens the door for other municipal police departments nationwide to work closely with the CIA in the war on terror.

The CIA's deep ties to the NYPD began when CIA Director George Tenet dispatched a widely respected officer, Larry Sanchez, to New York, where he became the architect of the police department's secret spying programs. At the NYPD, Sanchez worked side by side with David Cohen, a former senior CIA officer who became head of the department's intelligence division just months after 9/11.

Sanchez also hand-picked an NYPD detective to attend the "Farm," the CIA's training facility where its officers are turned into operatives. The detective, who completed the course but failed to graduate, returned to the police department where he works today armed with the agency's famed espionage skills.

Sanchez was on the CIA payroll from 2002 to 2004 and then took a temporary leave of absence to become deputy to Cohen.

In 2007, Sanchez left the CIA, staying on at the NYPD until late 2010. He now works as a security consultant in the Persian Gulf region.

Earlier this year, one of the CIA's most experienced clandestine operatives was detailed to the NYPD as special assistant to the deputy commissioner of intelligence.

Kelly has said the CIA operative provides "technical information" to the NYPD but "doesn't have access to any of our investigative files."
